Tool rentals can involve serious risk. Renters must use only equipment they are legally permitted, physically capable and sufficiently knowledgeable to use. Follow manufacturer instructions, warnings and operating limitations; use appropriate personal protective equipment; inspect equipment before use; and stop using any item that appears damaged, defective or unsafe.
Owners must not knowingly provide unsafe, recalled, unlawfully modified or materially defective equipment. Known defects, missing guards, operating restrictions and special safety requirements must be clearly disclosed before pickup.
ToolShare US does not inspect every listed item and does not guarantee that a tool, owner, renter, listing or location is safe. Users remain responsible for reasonable judgment, lawful conduct and safe handling.
Injury risk and responsibility
Using, transporting, loading, unloading, picking up and returning tools can cause serious bodily injury, illness, death or property damage. To the fullest extent permitted by law, each user knowingly assumes the risks arising from the user's selection, possession, transportation or use of a member-listed tool. ToolShare US, operated by Michelle Marina Thomas Ventures LLC, does not manufacture, own, inspect, maintain or control member-listed tools and is not responsible for injuries or property damage caused by a tool, an owner, a renter, unsafe use, failure to follow instructions or a condition that the owner or renter knew or reasonably should have discovered. This provision does not exclude liability that applicable law does not permit to be excluded.
